Terms & Conditions

Last updated: 13 October 2026

Please read these terms carefully before using our services or submitting an enquiry. By contacting us or submitting your property details, you agree to be bound by these terms.

1. About Us

SimplySell is a trading name of Etel Projects Ltd, a company registered in England and Wales with company number 17058038.

References to "SimplySell", "we", "us" or "our" in these terms refer to Etel Projects Ltd trading as SimplySell.

Our services are provided in England and Wales. These terms and conditions govern your use of our website and services.

2. Our Services

SimplySell provides a property cash-buying service for residential property owners in England and Wales. Our service is designed to facilitate a fast, straightforward property sale for homeowners who need certainty, speed or wish to avoid the traditional estate agency process.

Our service includes:

  • Assessment of your property details and situation
  • A no-obligation cash offer, where your property is suitable
  • Coordination of the legal conveyancing process
  • We contribute towards your legal fees. The amount depends on the property and the sale, and we’ll confirm it as part of your offer
  • Exchange and completion on timescales agreed between both parties

We purchase properties directly for cash. We do not act as estate agents and we do not list properties on the open market.

3. No Estate Agent Fees

SimplySell does not charge estate agent commission or fees to the seller. There is no fee payable by you for receiving an offer from us.

We contribute towards your legal fees. The amount depends on the property and the sale, and we’ll confirm it, with any conditions, in writing as part of your offer.

4. The Offer Process

Submitting an enquiry or property details does not create a binding contract between you and SimplySell. Any offer made by us is:

  • Subject to survey and formal property valuation
  • Subject to satisfactory legal searches and enquiries
  • Not legally binding until exchange of contracts
  • Made without obligation on either party to proceed

We reserve the right to withdraw or amend any offer prior to exchange of contracts if material information comes to light that was not disclosed at the time of the initial enquiry, or if the results of a survey or legal searches are materially different from information provided.

5. Eligibility — Legal Ownership

You must be the legal owner of the property to engage with us in any capacity. This includes initial enquiries, conversations, valuations and any subsequent negotiations. We are unable to discuss, assess or make any offer on a property with a person who is not the registered legal owner, or who does not have documented authority to act on behalf of all registered owners.

If the property is jointly owned, all legal owners must be in agreement and, where required, all owners must participate in the process.

By making contact with us — whether via our website, WhatsApp or any other means — you are confirming that you are the legal owner of the property you wish to discuss, or that you have the full legal authority to act on behalf of all owners.

SimplySell reserves the right to immediately cease all discussions and withdraw any offer if it becomes apparent that the person engaging with us is not the legal owner of the property or does not hold the requisite authority.

6. Proof of Ownership — Land Registry

Official HM Land Registry title documents must be provided before any offer or agreement is progressed. No formal offer will be made, and nothing will be agreed, until we have received and reviewed satisfactory proof of legal ownership.

Acceptable proof of ownership includes:

  • Official copies of the HM Land Registry title register (title absolute)
  • Official copies of the title plan registered with HM Land Registry
  • Where the property is unregistered, the original title deeds evidencing ownership

These documents may be obtained directly from HM Land Registry at gov.uk/search-property-information-land-registry. Your solicitor can also obtain these on your behalf.

Submission of Land Registry documents does not create a binding agreement and does not obligate either party to proceed with a sale. It is a condition of progressing any offer that ownership is properly verified in this way.

7. Your Further Obligations

In addition to the above, by submitting an enquiry you confirm that:

  • The information you provide about the property and your situation is accurate and complete to the best of your knowledge
  • You will promptly disclose any material facts relating to the property that may affect its value or saleability
  • You are not currently in a binding agreement with another party for the sale of the property, unless disclosed
  • You will provide Land Registry title documents promptly when requested in order to progress any offer

8. No-Obligation Advice

All initial conversations, property assessments and offers are provided on a completely no-obligation basis. You are under no obligation to accept any offer made by us, and you may withdraw from the process at any time prior to exchange of contracts without penalty.

9. Confidentiality

We treat all information you share with us as strictly confidential. Your property details and personal circumstances will not be shared with any third party without your consent, except where required by law or as necessary to facilitate the transaction (for example, with solicitors or surveyors acting on the purchase).

10. Data Protection

We are committed to protecting your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

The personal information you provide when submitting an enquiry (including your name, contact details and property information) will be used solely for the purpose of assessing and, where appropriate, progressing a purchase of your property.

We will not sell, rent or pass your personal data to third parties for marketing purposes. You have the right to request access to, correction of, or deletion of your personal data at any time by contacting us via WhatsApp or in writing.

11. Limitation of Liability

SimplySell (Etel Projects Ltd) shall not be liable for any indirect, consequential or special losses arising from your use of our services or reliance on any information provided by us prior to exchange of contracts.

Our liability to you for any direct losses shall not exceed the value of any costs reasonably incurred by you in connection with the abortive transaction, where we withdraw from a purchase without reasonable cause after exchange has occurred.

Nothing in these terms shall limit or exclude liability for death or personal injury caused by negligence, fraud or any other liability that cannot be excluded by law.

12. Website Use

The content on this website is provided for general information purposes only. Whilst we endeavour to keep the information accurate and up to date, we make no representations or warranties of any kind, express or implied, about the completeness or accuracy of any information on this site.

We reserve the right to modify or withdraw any part of this website or these terms at any time without notice. Your continued use of our services following any changes constitutes your acceptance of the updated terms.

13. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Contact

If you have any questions about these terms, please contact us via WhatsApp or by email. We aim to respond within one working day.
